Welcome to Onwills, an online will database and search platform operating in Ontario, Canada and owned by Onwills Corporation (“we”, “us”, or “our”).
By accessing or using the Onwills.ca website (the “Website”) or any of our services (“Services”), you agree to be bound by these Terms of Service (“Terms”), including our Privacy Policy.
If you do not agree to these Terms, you may not use our Services.
- “User”, “You”, or “Your”: Any individual or entity accessing the Website or using the Services.
- “We” or “Onwills” means Onwills Corporation.- “Will Record”: A registration of the existence and/or location of a will or similar document.
- “Will Search”: A request submitted through Onwills to determine whether a will record exists.
- “Registry”: Our database of registered will records.
- “Registrant”: The person or entity submitting a Will Record.
- “Will Maker”: The person who created the will referenced in a Will Record.
To use Onwills, you must:
- Be at least 18 years old;
- Have legal capacity to enter into contracts;
- Provide accurate and complete information;
- Ensure that any data you submit is correct and authorized.You are responsible for maintaining the confidentiality of your account and passwords. Notify us immediately if you suspect unauthorized access.
Onwills provides:
- A voluntary Will Registration Service allowing users to log the location and details of will-related documents;
- A Will Search Service that checks the Registry for any matching Will Records and notifies the Registrant or their representative of a search request.
- Where a potentially matching Will Record is identified, notification to the Registrant or their representative that a search request has been made; and
- A search certificate confirming that the Will Search was conducted and reflecting the results of the Registry search at the time it was submitted.
Important: A Will Search does not guarantee that a Will Record will be found or that a Registrant, lawyer, law firm, or other representative will respond to a search request. The Will Search and search certificate constitute the service purchased, regardless of whether a matching Will Record is identified or a response is received.
Onwills does not store actual will documents. The Registry contains information about registered wills and related documents, such as the Will Maker's name, the location of the document, and the person or organization identified as storing the document.
You acknowledge that:
- The Registry is voluntary and not every will or will-related document is registered with Onwills;
- The outcome of a Will Search depends on the information entered by users, Registrants, and third parties;
- Search results may be incomplete or inaccurate because of unregistered wills, missing information, spelling differences, typographical errors, or other discrepancies in the information provided;
- A negative search result does not mean or guarantee that no will exists;
- Search results reflect the information contained in the Registry at the time the search is submitted;
- If a potentially matching Will Record is identified, Onwills may notify the Registrant or their representative of the search request. Onwills cannot guarantee that the notification will be received, acknowledged, or acted upon;
- A Registrant, lawyer, law firm, or other representative may choose not to respond to a search request; and
- A Will Search does not guarantee that a will or copy of a will will ultimately be located or provided to you.
Onwills does not independently verify the accuracy or validity of submitted Will Records or the validity of any underlying will or will-related document.
The completion of a Will Search and issuance of the applicable search certificate constitute completion of the Will Search Service. A successful match, response from a Registrant or representative, or retrieval of a will is not guaranteed as part of the Service.
By using the Services, you confirm that:
- All data you submit (e.g., search terms, contact information, testator‘s name) is accurate;
- You have all necessary rights and permissions to register or search for will information.
You agree to indemnify and hold harmless Onwills Corporation, its officers, directors, employees, and agents from and against any claims, losses, damages, or costs (including legal fees) arising out of:
- The submission of inaccurate or unauthorized information by you;
- Failure by a third party to register a document;
- Failure by any person or firm to respond to an inquiry or disclose information;
- Any updates to the Registry made after your search was completed;
- Any reliance by you on incomplete, outdated, or incorrect results.
Fees for Services listed on our Website are subject to HST. Payment must be made in full at the time of ordering.
Fees for a Will Search cover the processing of the search against the Onwills Registry and the issuance of the applicable search certificate. Fees are not contingent on a matching Will Record being identified, a Registrant or representative responding to a search request, or a will ultimately being located or provided.
Refunds: You may cancel a request only if Onwills has not yet begun processing it. Once a Will Search has commenced, which may occur immediately after submission, the Service is considered in progress and no refund will be issued solely because:
- No matching Will Record is identified;
- A Registrant, lawyer, law firm, or other representative does not respond to the search request; or
- A will is not ultimately located or provided.
Information registered through Onwills:
- Remains the property of the Will Maker or their legal representatives;
- May only be permanently removed upon proof of authority (e.g., death certificate, probate documentation).
We reserve the right to verify the identity and authority of any individual requesting deletion of Will Records.
We protect user data in accordance with our Privacy Policy and all applicable privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
You acknowledge that the use of Services may involve the transmission of personal data over networks that we do not control.
While we aim to keep the Services operational 24/7, we do not guarantee uninterrupted access. Onwills is not responsible for service delays or downtime caused by:
- Maintenance, repairs, or system upgrades;
- Internet or network outages;
- Events beyond our control (e.g., cyberattacks, power failures).
To the maximum extent permitted by Ontario law, Onwills is not liable for:
- Inaccurate, missing, or outdated Will Records;
- Failure of search results to locate existing wills;
- Actions or omissions of registrants or third-party data providers;
- Losses arising from reliance on incomplete or incorrect search results;
- Any indirect, incidental, or consequential damages, including loss of business, revenue, or opportunity.
Our total liability, if any, is limited to the fees you paid for the affected Service.
We reserve the right to suspend or terminate your access to the Services without notice if:
- You breach these Terms;
- You misuse or fraudulently use the Services;
- Required by law or court order.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved in the courts located in Toronto, Ontario.
We may revise these Terms from time to time. The most current version will be posted on our Website. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
