No, we built Onwills in a way that meets lawyers’ obligations under privacy legislation and law society rules. In addition, we obtained a legal opinion from an independent major law firm that confirmed the statement below. If you wish to receive a copy of the legal opinion, please email us at
support@onwills.ca.
"Onwills processes client information solely for the purposes of providing Services to Source Firms. As a result, Source Firms may, without obtaining client consent, upload client information into their instance of the will repository for the purposes of obtaining the Services. Under PIPEDA, this sharing of client information with Onwills for the purposes of obtaining the Service is viewed as a transfer for processing, and not a disclosure, so no consent is required for the transfer. Under the LSO Rules, clients implicitly authorize their lawyers to share their information with service providers acting on the lawyer's behalf."
This legal opinion confirms that you already have your clients' consent to register their wills.
